What will the US settlement policy look like in 2020?

With the slogan "Make America Great Again", President Donald Trump is implementing many measures to reform the United States, including policies to tighten immigrants into the United States.

1. Strict policy of issuing and adjusting H-1B visas

The H-1B visa program is for high-skilled workers and international students in the United States. Many candidates have passed the program to get a green card to settle in the United States. However, Donald Trump sees this as a reason cause domestic workers to lose their jobs or reduce wages.

The Trump administration is developing and implementing the H-1B visa system that calculates applicants' achievements. The US Citizenship and Immigration Services (USCIS) has updated its review criterias with very strict criterias. USCIS has added requirements for legal criteria and proofs to approve or extend an H-1B Visa application. As a result, the visa program has added barriers and it is expected that the number of students who will find a job will fall by 4,000.

For H-1B Visa renewal applications, the rejection rate for appliances has also increased to over 18% (the previous rate was 3%). This shows that H-1B visa policy is increasingly difficult for foreign workers working in the US.

2. Strengthen the review and punishment of overdue visas

Those who knowingly stay in the US after the expiry of the visa are considered to be illegal residents. Each year, more than 600,000 people have overdue visas. Therefore, Donald Trump has asked the Ministry of Foreign Affairs and Homeland Security to review and punish severely overdue cases.

In addition, many sanctions and margin requirements have been released, with the expectation that visitors to the United States will not intentionally stay in the United States after the visa expires.

3. Restrict international students and travel from certain countries

For countries which the percentage of citizens overdue visas over 10%, the US will apply penalties including:

  • Limit the number of US visas in 2020 for that country
  • Limit the time citizens can stay in the US
  • Request for additional documents for visa applications
  • More stringent requirements when interviewing for a visa

Recently, the authorities in the US have investigated and destroyed the fake marriage gange of Vietnamese people in Houston. Accordingly, hundreds of people have been arrested and 96 have been indicted for joining a fake marriage gang. This is also a warning to the Vietnamese community, who are intending to immigrate illegally into the US by fake marriage.

5. Maintain investment attraction through the EB-5 and E2 Visa programs

Compared to other visa programs, the EB-5 and E2 immigrant investor programs still receive support policies, such as increasing the priority time for processing documents at USCIS, rapid document appraisal.

For the EB-5 program, the US government adjusted the amount of minimum investment by the end of 2019 to US $ 900,000 for a project conducted in targeted employment areas (T.E.A), and US $ 1,800,000 for for a project conducted in non-targeted employment areas. For the Visa E2 immigration investment program, the US government maintains a minimum investment of only $ 100,000 (depending on the type of investment).
